Grading & Service Terms
Black Grading Service GmbH
These Grading & Service Terms govern the specific conditions applicable to the submission, receipt, inspection, assessment, documentation, certification, encapsulation, digital registration and return of trading cards and other collectible items accepted by Black Grading Service.
They supplement the General Terms and Conditions of Black Grading Service GmbH.
By ordering an applicable service, the customer confirms that they have taken notice of these Grading & Service Terms.
1. Scope of the Service
Black Grading Service GmbH provides professional services for the inspection, condition assessment and certification of trading cards and, depending on the product ordered, their encapsulation and digital documentation.
Depending on the service ordered, processing may include in particular:
- identification of the card
- examination of relevant authenticity characteristics
- condition inspection
- assessment of centering
- assessment of corners
- assessment of edges
- assessment of the surface
- photographic or digital documentation
- assignment of a grading score
- creation of a certification record
- assignment of an individual certificate or serial number
- encapsulation in a Black Grading Service Case
- provision of a digital Defect & Grading Report
- inclusion in MySlaps
- inclusion in the Black Grading Service database
- inclusion in the Population Report
- additional digital features according to the product ordered
The specific scope of services is determined by the respective product description in the webshop.
2. Basis of Assessment
The assessment is carried out in accordance with the Black Grading Service grading standards and inspection procedures applicable at the time of processing.
The actual condition of the submitted card at the time of inspection is assessed.
Depending on the manufacturer, set, card type, material, printing process and design, different characteristics and reference points may be taken into account.
The final grading score is the result of the professional condition assessment performed by Black Grading Service.
The customer is entitled to a specific grade or minimum grade only where this is expressly included in the service ordered.
3. Grading Areas
The following areas in particular are taken into account during grading.
Centering
The position of the printed image in relation to the card borders or other reference points relevant to the respective design is assessed.
The front and back of the card may be assessed differently.
Corners
The examination may include:
- wear
- whitening
- rounding
- pressure marks
- damage
- material loss
- other visible irregularities
Edges
The examination may include:
- whitening
- chipping
- fraying
- printing defects
- damage
- irregularities in the card cut
Surface
The examination may include:
- scratches
- print lines
- stains
- dents
- pressure marks
- coating defects
- contamination
- surface damage
- production-related irregularities
Additional criteria may be included in the assessment depending on the type of card.
4. Order and Submission
The customer selects the desired grading service in the Black Grading Service webshop and completes the order using the designated checkout process.
After successful completion of the order, or together with the order confirmation, the customer receives an individual QR code for the submission.
This QR code is used to quickly and clearly assign the incoming shipment to the corresponding order.
5. Attaching the QR Code to the Outside of the Package
The provided QR code must be printed, cut out and attached in a clearly visible position on the outside of the shipping package.
To protect the QR code from rain, moisture, abrasion or dirt during transportation, we expressly recommend covering it completely with transparent adhesive tape or otherwise protecting it in a waterproof and transport-safe manner.
The QR code must:
- remain fully visible,
- remain clearly readable,
- be securely attached to the package,
- not be folded or damaged,
- be capable of being scanned easily upon arrival.
The QR code enables the shipment to be directly assigned to the relevant customer order when it is received.
6. Avoid Unnecessary Personal Data Inside the Package
Because the receipt and opening of submissions by Black Grading Service may be documented by video, unnecessary personal information should not be openly visible inside the shipment.
In particular, please avoid including additional notes, letters or documents containing:
- your full private address
- telephone number
- private email address
- date of birth
- bank details
- personal messages containing sensitive information
- other personal information not required for processing the order
The QR code attached to the outside of the package is generally intended for assigning the shipment to the relevant order.
Necessary shipping and sender information on the outside of the shipping package is unaffected by this provision.
7. Preparing the Cards
Cards must be adequately protected for shipping.
Black Grading Service generally recommends:
- Carefully place the card in a suitable sleeve.
- Then use a Toploader or Card Saver.
- Adequately protect cards against pressure and movement.
- Sufficiently cushion empty spaces inside the shipping package.
- Use stable shipping packaging.
8. Avoid Unnecessary Adhesive Tape Inside the Shipment
Unnecessary adhesive tape should be avoided inside the shipment wherever possible.
Sleeves, Toploaders, Card Savers or other card holders in particular should not be excessively or repeatedly taped closed.
Removing such tape may make safe removal of the card more difficult.
Because cards are handled appropriately with gloves upon receipt and throughout the grading process, adhesive residue that is difficult to remove may create an unnecessary risk.
As a general rule:
Use sufficient cushioning instead of unnecessary adhesive tape.
9. Shipping to Black Grading Service
The customer is responsible for properly and securely packaging the submission in a manner suitable for transportation.
The shipment must be correctly addressed.
We expressly recommend:
- shipping with tracking
- stable shipping packaging
- sufficient cushioning
- transport insurance appropriate to the value of the cards
The shipment to Black Grading Service is subject to statutory provisions and, where applicable, supplementary provisions contained in the General Terms and Conditions.
10. Documented Receipt of Goods
The receipt and opening of a submission by Black Grading Service may be documented by video.
The documentation may be used in particular to record:
- the condition in which the package arrived,
- whether externally visible damage was present,
- how the cards were packaged,
- which cards were actually included in the submission,
- how many cards were received,
- whether visible irregularities were already present when the package was opened.
The documentation is used in particular for quality assurance, traceability and clarification of possible discrepancies.
11. Use of Video Recordings
Black Grading Service may use video recordings of incoming submissions or suitable extracts from such recordings for documentation, information or content purposes where permitted under applicable data protection law.
Personal customer data should generally not be unnecessarily published.
For this reason, it is particularly important that no openly visible personal information that is unnecessary for processing is included inside the submission.
Where a separate legal basis or consent is required for publication, the applicable statutory requirements remain unaffected.
Further information about data processing can be found in the Black Grading Service Privacy Policy.
12. Removal from Sleeves and Card Holders
Professional grading requires the card to be removed from its sleeve, Toploader, Card Saver or comparable card holder.
By ordering the grading service, the customer agrees to this necessary handling of the card.
Black Grading Service handles cards with appropriate professional care.
13. Card Identification
During processing, information necessary to uniquely identify a card may be recorded.
This may include in particular:
- manufacturer
- franchise or TCG
- sport
- set
- year of release
- card number
- player
- character
- card name
- language
- variant
- parallel
- edition
- additional identification characteristics
If the card cannot be clearly identified, Black Grading Service may request additional information from the customer or suspend processing until clarification has been obtained.
14. No Guarantee of a Specific Grade
Black Grading Service does not guarantee any specific grading score.
This also applies where:
- the customer expects a particular grade,
- a dealer expects a particular grade,
- a pre-grading assessment exists,
- the card has previously been graded by another grading company,
- comparable cards on the market have received higher grades,
- the purchase price of the card suggests that a higher grade may be expected.
The professional assessment is carried out independently of the purchase price, market value or personal expectations of the customer.
15. Different Grading Companies
Different grading companies may use different grading standards, weighting systems, tolerances, inspection processes and measurement methods.
As a result, the same card may receive different grades from different grading companies.
A difference from the grade awarded by another grading company does not, by itself, constitute a defect in the service provided by Black Grading Service.
16. Market Value and Grading Result
The customer acknowledges that the market value of a trading card depends on numerous factors.
These include in particular:
- grading score
- condition
- rarity
- population
- demand
- market supply
- manufacturer
- set
- variant
- player or character
- previous certification
- market trends
- current selling prices
Black Grading Service does not guarantee any specific market value, selling price or development in the value of a card.
The role of Black Grading Service is to professionally assess and certify the condition of the card.
Grading does not constitute an investment, price or value guarantee.
17. Possible Changes in Value Due to Grading
A grading score may positively or negatively affect the market value of a card.
After grading, a card may have a higher, comparable or lower market value than before grading.
This depends in particular on the grading score awarded and the prevailing market situation.
A market-related change in value resulting solely from a professionally assigned grading score does not, by itself, establish a claim for compensation for loss of market value.
Mandatory statutory claims remain unaffected.
18. Ungraded Cards / Raw Cards
For ungraded cards, commonly referred to as Raw Cards, there is no bindingly established grading score before grading.
The market price of an ungraded card does not guarantee the value the card will have following a professional condition assessment.
For example, an ungraded card may have a market value of EUR 300 before submission.
If the card subsequently receives a lower grade than the customer expected due to its actual condition, its market value may decrease.
By commissioning the grading service, the customer acknowledges this general grading and market risk.
19. Previously Graded Cards and Crossgrading
Crossgrading involves the reassessment and grading by Black Grading Service of a card that has already been certified by another grading company.
The Black Grading Service grade may be higher than, equal to or lower than the existing grade awarded by the other grading company.
There is no entitlement to adoption or confirmation of the previous grade.
20. Example of a Lower Crossgrading Result
For example, a card previously graded PSA 9 may receive a grade of 8 following an independent assessment by Black Grading Service.
This does not automatically mean that the assessment is incorrect.
Black Grading Service evaluates the card independently according to its own grading standards applicable at the time of processing.
21. Opening an Existing Third-Party Slab
If opening an existing third-party slab forms part of the ordered crossgrading service, the customer agrees to the professional opening of the slab.
Opening the existing slab permanently removes its original seal.
The original condition of the card within the previous third-party slab generally cannot be fully restored after opening.
This applies in particular to the original case, original seal, label, physical presentation and previous certification in the original slab.
22. Economic Risk of Crossgrading
The customer expressly acknowledges that opening and subsequently reassessing a previously certified card may have financial consequences.
For example, if a card previously certified as PSA 9 is opened and subsequently receives a lower grade from Black Grading Service, this may result in a lower market value.
This risk forms part of the reassessment commissioned by the customer.
Black Grading Service does not guarantee that crossgrading will:
- preserve the previous market value,
- confirm the previous grading score,
- result in a higher grading score,
- allow the card to subsequently be sold for the same or a higher price.
A reduction in market value resulting solely from a professionally conducted reassessment does not, by itself, establish a claim for damages.
This does not apply to damage caused by a breach of duty attributable to Black Grading Service.
23. Minimum Grade for Crossgrading
Where Black Grading Service offers a crossgrading service with an expressly agreed minimum grade or comparable protection option, the conditions of the relevant product shall also apply.
A minimum grade applies only where it is expressly included in the service ordered.
For standard crossgrading without an agreed minimum grade, there is no entitlement to have the existing grade matched or exceeded.
24. No Compensation for Pure Market or Speculative Losses
Black Grading Service does not guarantee market-related or speculative changes in value.
This applies in particular to changes in value resulting from:
- grades lower than expected
- market fluctuations
- changes in demand
- changes in population
- price changes on marketplaces
- changes in collector preferences
- reassessments in connection with crossgrading
- different assessments by different grading companies
Mandatory statutory liability claims remain unaffected.
25. Altered or Manipulated Cards
Where there are indications that a card has been altered, manipulated or subsequently modified, Black Grading Service may refuse a standard grade or certification or assign an appropriate status.
This may include in particular:
- cards that have subsequently been trimmed
- restored cards
- altered surfaces
- modified corners
- modified edges
- subsequently applied coatings
- artificially removed damage
- other forms of manipulation
26. Authenticity
Where there are substantial doubts regarding the authenticity of a card, Black Grading Service may refuse standard certification.
Such a decision does not necessarily constitute a final legal determination that the card is counterfeit.
It may also mean that authenticity could not be sufficiently confirmed using the available inspection procedures.
27. Cards That Cannot Be Graded
Black Grading Service may refuse standard grading where a card is technically or materially unsuitable for the selected service.
This may apply, for example, to:
- unsupported card formats
- unsupported card thicknesses
- extreme damage
- severe deformation
- foreign objects
- cards that cannot be securely encapsulated
- unsupported card types
The specific handling of such cases depends on the product ordered.
28. Encapsulation in the Black Grading Service Case
Where included in the service ordered, the card will be encapsulated in a Black Grading Service Case after completion of the assessment.
The Case is intended in particular to protect the card, provide permanent presentation, associate it with the grading result, provide certification and enable identification.
If the Case is subsequently opened, damaged or manipulated, the original certification may cease to be valid.
29. Certificate and Serial Number
Depending on the service ordered, graded cards receive an individual certificate or serial number.
This enables the digital record to be uniquely identified within the Black Grading Service system.
30. Digital Defect & Grading Report
Depending on the product ordered, a digital Defect & Grading Report may be provided for a graded card.
This may include:
- card identification
- overall grade
- subgrades
- digital card images
- condition information
- defect markers
- visible irregularities
- certificate information
- additional digital inspection data
The specific scope depends on the relevant product.
31. MySlaps
For supported grading products, the customer receives access to the MySlaps portal.
The corresponding graded cards can be managed there within the customer's personal digital collection.
Depending on technical availability, cards or slabs may additionally be displayed digitally or in a three-dimensional representation.
MySlaps therefore connects the physically graded card with the digital Black Grading Service ecosystem.
32. Database and Certificate Verification
Black Grading Service provides a digital database or certificate verification function.
Information available for the respective record can be accessed using its certificate or serial number.
This makes it possible to verify whether a Black Grading Service certification record exists for a particular card.
33. Population Report
Graded cards may be included in the Black Grading Service Population Report.
Based on the available data, the Population Report may show in particular:
- how many examples of a card have been recorded by Black Grading Service,
- how the existing grading scores are distributed,
- how frequently particular grading levels occur within the population.
The population changes continuously as new cards are graded.
Population figures do not guarantee the market value of a card.
34. Blackcoin
Where available within the relevant customer account or webshop, Blackcoin may form part of the Black Grading Service ecosystem.
Additional product or usage terms may apply to Blackcoin and individual functions connected with it.
Blackcoin has no influence on the professional grading of a card.
35. All-in-One System
The Black Grading Service webshop may connect various areas within a central system.
These may include in particular:
- grading orders
- customer account
- MySlaps
- certificate database
- certificate verification
- Population Report
- digital Defect & Grading Report
- Blackcoin
- additional future digital services
The specific range of functions depends on technical availability and the service ordered.
36. Processing Times
The processing times stated in the webshop depend on the respective grading service.
Unless a binding deadline is expressly guaranteed, stated processing times are estimates or target processing times.
The processing period generally begins only once:
- the shipment has been received by Black Grading Service,
- the QR code or order has been successfully assigned,
- all required information is available,
- the required payment has been made in full.
Delays may arise in particular as a result of:
- exceptionally high order volumes
- additional inspections
- identification issues
- requests for additional information
- technical disruptions
- special card characteristics
- force majeure
- other circumstances outside the immediate control of Black Grading Service
37. Order Status
Where technically available, customers may track the processing status of their submission through their customer account.
The status display is intended to provide guidance regarding progress through the processing workflow.
Short delays in the updating of digital status information may occur.
38. Declared Card Value
Where the customer is asked to provide a card value during the ordering process, this information is used in particular for selecting the appropriate grading service, insurance level or other product-specific requirements.
A card value stated by the customer does not constitute confirmation of that market value by Black Grading Service.
By accepting the declared value, Black Grading Service does not perform a binding market valuation.
39. Value Insurance
Where stated for the applicable grading product, value insurance of up to EUR 500 is included in the service.
Higher insurance amounts may be purchased separately where offered in the webshop.
The exact amount and scope of insurance depend on the product ordered, any additional insurance selected, the shipping method and the applicable insurance terms.
Providing a card value does not guarantee that an insurer will automatically reimburse exactly that amount in the event of a claim.
40. Return Shipping
After completion of the ordered services, the cards will be returned to the delivery address provided by the customer.
The shipping method, shipping costs and insurance depend on the selected or agreed shipping option.
The customer is responsible for providing a complete and deliverable shipping address.
41. Card Handling During Grading
Professional grading requires physical handling of the card.
This may include in particular:
- removal from the shipping packaging
- removal from sleeves
- removal from Toploaders or Card Savers
- photographic recording
- positioning
- rotation of the card
- inspection under different lighting conditions
- measurement
- surface inspection
- inspection of corners and edges
- placement in the Black Grading Service Case
- encapsulation
Black Grading Service performs these processes with appropriate professional care.
42. Pre-Existing Damage
Highly sensitive, previously damaged, bent, broken, delaminated or otherwise structurally unstable cards may already have weaknesses before grading.
As a result of proper and necessary card handling, existing defects may become more clearly visible or, in the case of exceptionally unstable cards, may change.
Documentation created when the shipment was received may be used to clarify such matters.
43. Liability
Black Grading Service is liable in accordance with statutory provisions.
This applies without limitation in particular in cases of:
- intent
- gross negligence
- injury to life
- bodily injury
- damage to health
Further legally permissible liability provisions may be contained in the General Terms and Conditions.
Mandatory statutory rights of the customer remain unaffected.
44. Difference Between Physical Card Damage and Market Value Loss
Actual physical damage to a card must be distinguished from a change in market value resulting from a grading score.
A lower grading result or market-related reduction in value does not automatically constitute physical damage to the card.
If Black Grading Service professionally assesses a card and, for example, awards a grade of only 7 or 8 instead of an expected 9, the resulting change in market value is generally a consequence of the condition identified and the market's response to that grade.
Mandatory statutory liability claims relating to actual damage attributable to Black Grading Service remain unaffected.
45. Complaints
If, after receiving the returned submission, the customer identifies damage, incorrect assignment or another discrepancy, Black Grading Service should be contacted through the designated support channel as promptly as possible.
The following information may in particular be required for the review:
- order number
- certificate number
- photographs of the card
- photographs of the Case
- photographs of the shipping packaging
- description of the matter
This request does not restrict any statutory rights.
46. Regrading and Reassessment
A grading score that has already been assigned will not be changed solely because the customer has a different personal assessment.
If the card is to undergo another complete assessment, a separate regrading, review or comparable service may be required.
A new assessment does not guarantee a higher, identical or lower grade.
47. Right of Withdrawal
Consumers are entitled to the statutory right of withdrawal.
Details are set out in the separate Cancellation Policy of Black Grading Service.
Where the statutory requirements are met, the withdrawal period is generally 14 days.
48. Early Commencement of the Service
If the customer expressly wishes Black Grading Service to begin providing the service before the end of an applicable withdrawal period, the legally required declarations may be obtained during the ordering process.
Services that have already begun or have been fully performed are subject to the applicable statutory provisions governing the right of withdrawal.
49. Data Protection
Black Grading Service processes personal data in accordance with applicable data protection laws and its Privacy Policy.
This applies in particular to data associated with:
- customer accounts
- orders
- submissions
- payment processing
- shipping
- video documentation of incoming submissions
- certificates
- digital grading reports
- MySlaps
- support requests
Personal data should be processed only to the extent necessary for the relevant purpose. The principle of data minimisation is established in Article 5 GDPR.
50. Further Development of Digital Functions
Black Grading Service continuously develops its systems, grading processes and additional digital functions.
This may include, for example:
- MySlaps
- database
- Population Report
- certificate verification
- digital Defect & Grading Reports
- Blackcoin
- customer account
- additional digital functions
Such functions may be technically expanded, modified or further developed.
The core service owed for a particular order is determined by the product description applicable at the time the contract is concluded.
51. Relationship with the General Terms and Conditions
These Grading & Service Terms supplement the General Terms and Conditions of Black Grading Service GmbH.
Where these Grading & Service Terms do not contain a more specific provision, the General Terms and Conditions of the webshop apply.
Mandatory statutory consumer rights remain unaffected.
52. Contact and Support
For questions concerning an order, submission or grading order, customers may contact the official Black Grading Service support service.
For existing orders, the relevant order number or certificate number should be provided wherever possible.
